Medical Marijuana - Colorado's Laws and Information

Colorado is one of the twelve states that allow the medical use of marijuana. In November of 2000 the majority of voters to allow patients with certain illnesses to use marijuana medicinally passed an amendment called Amendment 20. This is controlled by the Colorado Department of Public Health and Environment. You must obtain a Medical Marijuana Registry identification card in order to use marijuana medicinally without facing criminal penalties.

To qualify for the medical use of marijuana you have to have a debilitating medical condition. These conditions include cancer, glaucoma, HIV, AIDS, cachexia, severe pain, severe nausea, seizures not limiting the symptoms to epilepsy, and muscle spasms not limiting the symptoms to multiple sclerosis. A patient as well as a physician may send a petition to the Colorado Department of Public Health and Environment to include other medical conditions that would benefit from the medical use of marijuana.

A patient that is diagnosed with one of those medical conditions that would have symptoms alleviated by the use of marijuana needs to apply for a Medical Marijuana Registry identification card. You first need to obtain a certification from a physician that is licensed in the state of Colorado that states you will benefit from the medicinal use of marijuana. The physician should keep copies of this on file for the verification process. Then the patient must submit an application form obtained from the Colorado Department of Public Health and Environment along with the physicians certification and send it in with a money order or check of $90.00 to the Colorado Department of Public Health and Environment. The Medical Marijuana Registry will contact your physician to verify tour certification and let you know within 5 days if you disqualify. If you qualify it will take up to 30 days.

If you qualified for the medical use of marijuana in Colorado you are allowed to cultivate your own product. You are allowed to carry no more than two ounces of dried pot on your person. You are allowed to have up to six marijuana plants growing at once. Three of these plants have to be mature and the three have to be immature. The mature plants count if they have flowering buds that are producing marijuana that can be smoked. The immature plants cannot have any vegetation, flowering, or buds on them and cant be more than twelve inches high. Follow these laws and you will not be subject to criminal penalties.
