Know Your Necessary Divorce Documents
In order to file for divorce you need to start with a proper set of divorce papers. If you are comfortable with the knowledge of the underlying requirements for your particular divorce (residency, grounds for divorce, remedies) you can use an online divorce service for preparing your legal forms.

Many of the online services are free or charge a modest fee. Once you have an air tight divorce file, you can either file the papers yourself at the proper county courthouse or use a filing service to achieve the same objective.

One of the prerequisites is that you serve your spouse with the divorce papers. In an uncontested divorce where your spouse is cooperative, you can get your spouse's consent to the service of the divorce papers. Otherwise, it will be necessary to prepare a summons, which is a notice of the filing of the divorce papers, that should be served along with the divorce papers by a third party, such as a sheriff, on your spouse. Failure to show the divorce court proof of service of the documents may slow down your divorce process.

Upon filing a simple set of divorce papers in the required county courthouse, there is sometimes, in many states, a statutory waiting period (often 30 days) before the divorce becomes effective. Therefore, for your planning purposes, you need to know whether the act of filing the divorce papers is the final step in the divorce process or whether there are any post-filing time periods or requirements in order to finalize the matter.

Each state has its own requirements for how the divorce papers should be completed or filled in. While the requirements are relatively similar from state to state, it is important for filing purposes that your, say New York, divorce papers use the terminology required by New York's divorce laws. Otherwise, your divorce papers are inadequate as a matter of law and not ready to file. If you attempt to file such documents, then they will be rejected by the clerk in charge of document processing.

It is not necessary to use a divorce attorney to file divorce papers. If you have prepared your papers online with the use of an online service or with a hard copy of documents mailed to you, there will be instructions of how and where to file the completed divorce papers in conformity with the statutory requirements of the state.
