Georgia Divorce Process Explained
Like most other states, a Georgia divorce commences with the filing of a complaint or summons with a Georgia divorce court.

Georgia divorce law requires that the filing spouse must have lived in Georgia for at least 6 months and file the divorce complaint in the county of his/her residency. A Georgia lawyer would counsel you that Georgia law follows a no fault divorce guideline ("irretrievable breakdown" of the marriage).

Georgia divorce law also provides for actions based on more traditional fault grounds such as adultery, separation, confinement for insanity etc. Once the divorce is finalized, it will become part of the public records.

No Divorce Mediation Provisions

Under Georgia divorce law and Georgia statutes, there are no express provisions for divorce mediation. Nevertheless, divorce mediation can be a court directed alternative to litigation in Georgia.

Divorce mediation offers the possibility of reduced costs and shorter time frames to complete the marriage dissolution process. Normally, mediation services are charged on an hourly basis and billed at the end of each mediation session.

The outcome of the mediation process is not binding upon a party unless that party consents and is willing to enter into a Marital Settlement Agreement as to the terms worked out during mediation. Georgia divorce mediation process is confidential (except for custody and visitation recommendations from the Family Court Services) so that an offer made during mediation (for say alimony) cannot be used in court against the party making the offer if the mediation process breaks down.

It is not unusual for one or both the mediation participants to have an attorney counseling from the sidelines as to overall matters under Georgia divorce law.

If you decide to retain a Georgia divorce lawyer, it is important to select the lawyer early in the divorce process in order to avoid mistakes such as a premature divorce filing that may compromise assets and income. There are many good lawyers in Georgia with in-depth experience as to the intricacies of Georgia divorce law.

Word of mouth from family, friends or associates can help narrow the field of available lawyers.
