Laws for Ohio Power of Attorneys
If your power of attorney form is covering any real estate dealings, the power of attorney form must be recorded by your county registrar. Sign and date the form in their offices and make sure they notarize it. If you later revoke that Ohio power of attorney, the revocation notice must be registered with the county too.
All durable power of attorney forms must contain the following phrase or a variation of it:
· “This power of attorney shall not be affected by disability of the principal or lapse of time”
The power of attorney form is not legal unless this phrase is included.
It is important that the power of attorney includes a specific time frame the agent will fill his role or when the power of attorney will come into effect.
If you have a power of attorney agent, you may also decide to make that person your guardian. This is commonly used for those with minor children who will need supervision and a loving home.
Death ends a power of attorney, but the agent will not be held responsible for actions he performed before he was aware of the principal's death.
Ohio Medical Power of Attorney
A medical power of attorney grants the person you designate to act as your medical advocate if you cannot speak for yourself. Things a medical power of attorney agent might handle include deciding whether you should remain on life support, if a feeding tube should be offered or if your doctor should try a risky surgery to improve your medical condition.
If your doctor is unwilling to perform a specific treatment, the power of attorney has the power to ask you be transferred to another facility. The doctor must arrange treatment. In addition, you can place terms on the care and treatment plans you wish the agent to follow
